Zusammenfassung
Es wurden Daten außergerichtlicher Schlichtungsverfahren bei Ureterläsionen während gynäkologischer Eingriffe aus einem Zeitraum von 2000 bis 2011 analysiert. In einer Stichprobe von insgesamt 173 Fällen sind bei 82 Verfahren (47,4%) ärztliche Fehler festgestellt und in 78 Fällen (45,1%) Haftungsansprüchen stattgegeben worden. Diese hohe Fehler- und Schadensgeneigtheit von Verletzungen der Harnleiter liegt weit über der Haftungsquote von 28% für sämtliche im genannten Zeitraum abgeschlossenen Verfahren aller Fachgebiete.
Abstract
Ureteral lesions during gynecological surgery are underreported. Between 2000 and 2011 a total of 173 cases were brought before the north German arbitration committee. In 82 patients (47.4%) medical malpractice was found with liability in 78 (45.1%) patients. Ureteral lesions cause a high rate of errors in comparison with only 28 % of medical errors in all other medical specialties.
